but apparently the cops haven’t yet been given any advice on how to deal with the shops openly selling them by CPS …..
many shops which sell shrooms also sell other, legal, items such as cyberkid clubbing gear, records and tapes, cigarette lighters etc
UK cops are supposed to be “proportionate” – it would be stupid for cops to heavily bust these places as there is a strong argument that although they clearly do support “drug culture” and are therefore in some legal/moral grey areas (as far as “conventional morality” is concerned), 90% of what else they do is legal and goes through proper channels.
These shops certainly annoy middle england with some of their stock; but shrooms aside are no worse in legal terms than sex shops, or shops which claim to sell “model aircraft/hobby stuff” but are often full of knives and replica guns.
The “clubbers/ravers gear” shops pay taxes/rates like any other shops ; they are also small businesses which employ young people who may, following the loss of their business they have worked hard to set up, otherwise be tempted into more questionable forms of earning a living such as more major drug dealing (bear in mind the customers of these shops would often be drug users!)
When the authorities do finally get their act together, I would expect a first offence would result in confiscation of the offending items and a caution – the main punishment would be the financial loss caused to the business by the removal of the stock of mushrooms. However continued offending would result in the usual class A dealing penalties; which can and do include prison terms.
It would not however surprise me though if CPS and the Police did get a plan of action sorted before the summer festival season…and when the inevitable crackdown happens, we can no longer allow people to sell shrooms on this board; these posts will, unfortunately, have to be deleted like other posts selling illegal drugs. The Internet is no longer “above the law”.

Yes yess, I know, the law has gone through all three stages (commons, lords, and given royal go ahead!), but the gov. have not yet implemented the law due to the fact they feel the need to first introduce secondary legislation to protect the big landowners so they don’t get done for having english shrooms growing on their land. (something along the lines of ‘If shrooms are growing on your land without your knowledge your not liable’ but with loads more legal jargon and stuff.)
This information has come direct from the Drugs policy dept. of the home office (phoned them myself to get it clear as lots of hear-say going around).
The change is looming VERY close, so a lot of people have just stopped selling them rather than run the risk of waking up to find their stock is now illegal, or even worse, not realising and getting nicked for loadsa class A (max sent. Life in prison for selling class A).
I am a bit stubborn and don’t like to pander to big bro too much, so am selluing them to the last !!!!! (will stop JUST before it becomes illegal tho, so check out my site every so often and if they vanish from there, its happened!!!!!)

hope you used a phone box (civil service departments log incoming call numbers of all people who ring them and the details of their queries, there are two sides to “freedom of information”!) BTW the person who answered the phone is often an overworked disgruntled clerk with their job under threat of downsizing who is often equally stubborn…
I’ve had a look myself at what home office say on their official channels (websites are also classed as official). There is no clear mention of what you say (although I don’t doubt it is a true reflection of your conversation) – apart from something buried on “talk to frank” which warns people the law will change sometimes…
But I’d be wary of even what the home office say unless it is in writing – that answer can be interpreted in two ways…. it could also mean “shrooms are class A” – but we are not yet enforcing the law in some situations until it has been altered. But cops could equally decide to enforce it in other situations.
Did you get a full answer in writing? Its not worth jack shit otherwise.
I don’t mean to get at you personally and I appreciate you must be gutted like everyone else about the laws and are trying to squeeze the last few sales out of this loophole before this is all locked down, but Govts are very smart at dealing with people who try and play games with them and/or use “official channels” to bend the rules – there is still a potential danger for the punters who are going to festivals with these items.
My response is aimed more at young people who may not be sure about the risks they are taking, not at business people like yourselves who are sensible enough to research the rules and regulations.
I also have a few friends who work for the security at commercial festies and have (unfortunately) to liase with cops when people get busted for drugs.
Those who get caught with shrooms will probably get busted anyway, cops don’t always obey the letter of the law as you no doubt know or will interpret it how they feel – they will no doubt still arrest people who attend a festival with them on suspicion of posessing class A (which gives them the excuse to take them away from the festival, strip search them, nick them for whatever else may be found and have them ejected from the festival even though they have paid for a ticket).
if they whinge, they will be given the choice of a formal adult caution (which they would have got anyway for most class A for personal use) or being bailed (and having to travel at their own expense once more to a police station often remote from their homes) and protesting about the unclear application of the “law” in Court! Most people will cut their losses and take the caution at that point. This is a procedure which occurs with many “questionable” arrests, not just for drug use.
Either way the cops have “won” because they have inconvenienced the drug user, they have lost their stash and the chance to be at the festival…
OTOH until such date as the law is enforced, ppl can always stock up for less commercialised events where they are less likely to be searched 😉
I just got back from glastonbury, where there were several stalls openly selling shrooms with police walking right past,. I also sold them on foot all weekend with a sigh held out saying ‘MAGIC MUSHROOMS’, If they were illegal I rekon I would have been arrested by now !!!!
BUT….. I have just had a letter from the Home Office… Clause 21 WILL be implimented on July 18th. So enjoy your last few legal trips while you still can !!!!!

As from the 18th july all shrooms are class A in any form (any fungi containing psilocybin or psylocin)

Fly agaric is still legal in the UK as it doesn’t contain any of these substances, instead it contains muscimol.
Fly agaric also contains alkaloids that are toxic, these can be removed either by feeding shrooms to reindeer and drinking the piss, or drying them at 170 deg. C.
The ones on my site have been dried at 170 deg. C to kill the toxins, so no piss drinking required !

although you (mikeid22) “escaped” at glastonbury, it looks like you were lucky… can’t help but wonder if the other emergency (floods) took priority or cops just let that festival go to get intelligence on who the shroom sellers were.. (look in our other thread and you will see the sheer amount of surveillance kit deployed at glastonbury, shocking stuff)
I will need to check how the Drugs Bill became law, but have a nasty feeling that the anti-shroom law could actually have been enforced any time between Royal Assent (the Drugs Act was fast-tracked before the election as it was part of Blair’s manifesto promises) and 7/18, it was merely that the Home Office and ACPO made a voluntary decision not to enforce the law until they had given cops/CPS suitable advice and the sellers a period of grace, so the courts would not be flooded with cases.
This still left the field open for cops to use the new law at their discretion (for instance to take out a shroom dealer who was selling other class A’s), and the posession charge could still also be used. posession of dried shrooms had always been illegal before the law as well which was a further risk to punters buying them at festies (unless they had the sense to eat them before nosey bobbies wandered about), and an intent to supply charge is invariably backed up by a posession charge..
I was looking at the police press releases for Guilfest (which happened from 2005-07-15 to 2005-07-17 (note those dates)) in the Surrey Police area.
This is the start of the pressrel. I’ve removed the names of those arrested as I don’t think there’s any need to make their lives even worse by publicising their arrests further, its not as if they’ve done violence or real crime..
the pressrel didn’t say who had shrooms, but the cops somehow managed to justify nicking them 2 days before the law came in – and kept them in over the whole weekend and had them all brought before Court!

Drugs seized at the festival ranged from substances believed to be ecstasy to MDMA crystals, magic mushrooms and herbal cannabis. All eight people arrested were charged and refused police bail for offences involving the supply or possession of Class A drugs. They all appeared at South West Surrey Magistrates’ Court on Monday (July 18).

shrooms def. were not illegal til 18th july, I have the letter from the home office and have posted it on the forum. I didn’t ‘escape’ the cops at glasto, I openly walked past them with a shrooms sign in front of me.
Their was one stall that just sold shrooms and nothing else ! kilo’s and kilo’s out in the open. Some police were mis-informed regarding the timing of the new law, but this was soon put right.
As soon as the new law came into effect (18th) their were arrests and busts made (19th !).
The reason for the delayed implementation was to allow secondary legislation to be brought in covering people who have british shrooms growing on their land.
this took some time, and resulted in some funny exemptions from the law !
I could forward the email sent to me by Jeremy Sare from Drug Legislation and Enforcement Unit of the Home Office if that would help.
I also think they caused the confusion on purpose to try to scare retailers into stopping selling before they were legally obliged to. It worked too ! (apart from a few stuborn people like me who constantly foned the home office to get updates.

by “escaped” I mean the authorities just didn’t bother you that time, not that they would chase after shroom sellers at glasto rather like Benny Hill, I would expect they would have simply monitored the stalls so they could bust those who continued selling post 7/18.
IIRC it was the Scots who were first to bust the headshops, doesnt’ surprise me as Scotlands government are going on a big anti-drugs purge at the moment.
There are different charges – intent to supply or supplying, and mere posession.
The loophole allowed the sale of fresh mushrooms (provided you paid VAT), but posession of them once they had dried out could still be deemed illegal…. having dried shrooms in your pocket always did and always will pose a risk of being nicked.
Cops still busted a few headshops pre 7/18 on “suspicion of posession” grounds, usually after locals whinged. not sure of the outcome but would expect people were let off minus mushrooms (and thus the shop would have had a financial loss, which is what the cops would have been after).
you can be done on suspicioun of anything (I’ve been nicked myself because of this). often the arrest is just to piss you off rather than get a Court case or caution – I would expect the Guilfest arrests were posession of shrooms as well as supply class A….
I’ve just checked a criminal law book dated 1998 (one of the same ones used by the CPS and old bill) which mentions the situation regarding mushrooms, and basically advises that constables can nick anyone with picked and dried psilocybin mushrooms.
the dangers I were highlighting earlier in the summer were not so much for people like yourself as they are sold damp and fresh, but for the unfortunate punters who bought some shrooms at a festie whilst being watched by the CID, and then got busted enroute to their tent.
what was happening pre 7/18 is that people were becoming complacent thinking they could carry any mushroom preparation about with impunity and not stashing the stuff like you would any other recreational drug.
Of course if the shrooms weren’t dry when the unfortunate festival goer was nicked, they will be after being locked in a property store cupboard (and perhaps even left on top of a heater?)….
incidentally I forgot to mention surpol used the “electronic sniffer dogs” randomly at Guilfest. A place best boycotted next year methinks…
Yer, I agree. The cops were def. trying to cost shops cash pre 18th, and also intimidate shop keepers and punters alike. Thats why forums like this are good, as it empowers people, and allows freedom of free information exchange. (cops will get away with loads of stuff if they think you don’t know your rights ! (been there, argued and won due to the home office letter and not backing down!)
That is why I posted the new one that mentions fly agarics, and reasons you can be pick shrooms (when on your land, uncultavated with the intent of destroying asap!).
If anyone intends carrying fly agarics, whever from my website or elsewhere, then print off the letter I posted and keep it with you (has contact number for Jeremy from drugs policy dept. of home office if the cops want to get it validated or clarrified so they should have no excuse for confiscate or arrest !)

Shrooms were defo not illegal until the 17th or 18th of July as I remember the stall sellers at the Glade telling everyone it was the last time they could legally buy them…
