Hi there,
This may have been established before, but I can’t find any threads on it here on via a google search.
The CJA act, section 63, 64 states: This section applies to a gathering on land in the open air of 100 or more persons (whether or not trespassers) at which amplified music is played during the NIGHT (with or without intermissions)
I cannot find a clear legal definition of “night” or “night time”, but one government website vaguely states “‘Night’ is generally the period between 11.00 pm and 6.00 am.”
If this is a legitimate definition, do police have any power to close a free party in the day time, and more importantly, can they close a free party which has been going on during the night if the section is not issued before 6am?
Cheers
Yeah but I think the cops tend to move on the whole unlicenced event policy these days, not sure though mind. Also not sure how it would work if the cops already know about the party at night, but don’t make a move on it untill the morning. Intresting though chers for posting.
I’m sure you will get a few more comments on this one.
