TOTP ‘may breach licensing law’
BBC chart show Top of the Pops may be breaking the law by hosting live music without a licence, according to west London council officials.
But there will be no attempt to stop this week’s show – even though it could technically breach the Licensing Act.
Hammersmith & Fulham Council said it depended on whether the recordings at BBC Television Centre were interpreted as public or private events.
A BBC spokesman said a licence would be obtained if one was required.
“The recording of live performances before a limited, invited studio audience has always been treated by the BBC and the council as constituting a live event not requiring a live performance licence,” he said.
“In the event that a different approach is now required, the BBC will apply for the appropriate licence.”
‘Essential’ audiences
The council’s attention was reportedly drawn to the programme after it staged an open-air concert at TV Centre on Saturday featuring US rock band Red Hot Chili Peppers.
“If they didn’t have an audience for Top of the Pops, it is our understanding that they wouldn’t be in breach of the Licensing Act,” council spokeswoman Louise Neilan told BBC Radio 4’s Today programme.
Her comments earned a stern rebuke from radio DJ Mike Read, who said live audiences had been “an essential part” of the show since it began in 1964.
Breaching the 2003 Licensing Act can result in a £20,000 fine and up to six months in prison.

if the bbc are in breach of PEL so are the bands and equipment owners under the new admendments, also if they are doing the events with a aim to make money then they maybe on dodgy ground, not sure about that tho without rereading the act.
much of the equipment is aunties own stuff (TOTP is a standing joke amongst bands as often they are miming and using instruments which don’t even make the right sound)
and to get a ticket to an auntie show you just ring up and its first come first served – same with those done at the London Studios (LWT), Teddington, Riverside, Shepperton etc…
been to LWT to watch comedies being recorded – didn’t have to pay or anything..
hang on if this goes through this means that every TV music show could be stopped, surely kiddies CD:UK is illegal then?

actually ISTR ITV companies investigating the potential use of regional TV studios in the 90s as music venues (to make more money as TV production increasingly moved to location shooting) which may indeed have fallen through because of the earlier version of this law..
thats a real shame ; the sound proofing in those places would have meant we would have annoyed far less people with our love of music and dancing
and they are huge and we could have had lovely big parties too;

I was only a kid when that track was out…. but there was also a punk revival in the 80s (at least for angst-ridden teenagers)
