  • I have just got back from Thailand and looking at my bank statement I have come to realise that I have been charged 30 quid to draw MY money out! Is this not classed as being unjusified? I meen what difference does it make to them that I am using a cash point in another country? I realise that you can claim back money from cheques being overdrawn etc, but does this count as one those ridiculous charges! I don’t understand why I have to pay for MY OWN MONEY! :you_crazy This happend to anybody else?

I used to work in a bank and 30quid is a standard charge for going OD. To withdraw cash from an ATM in a foreign country usually costs £2.
    :yakk:

Was charged 40 the other day for a bounced cheque. I remembered something on the news from a couple of months back about them not being allowed to do it so I looked into the legal side of it and found that it is actually illegal for banks to charge more than 12 quid for a default charge (anything above this is deemed to be unfair as it does not represent the actual administrative cost of dealing with your account going overdrawn – this is actually in the region of a few pence for mailing you an automated letter). Banks use these charges to recover losses from elsewhere such as those from money lending.

If you go to this website http://www.bankcharges.info/ you can download a template letter that looks to have been written by a solicitor. Just put your name and account details in it and describe what happened and mail it to your bank’s head office. I did this yesterday and I am awaiting a reply. Apparently this letter has worked for lots of people. Someone I spoke to told me it usually works but the bank might close your account just to be a bastard (they’re welcome to do that as far as i’m concerned as im the best part of 2 grand in the red now anyway!).

The letter does generally work but unfortunately the bank usually throws you out!

these are all on hold at the moment as the major banks are taking a test case to the high court

yea, missed the boat. if you go into your branch and talk to them you’ll get most of it back, but not as much as people were before it got out of hand and the banks decided to go to court.

its fairly likely the banks will win their case. i mean, when do they not?

i did have a visa/electron account but then upgraded to a proper visa…….so i left my other account alone, without realizing that i was a pound over draw…..wen i went 2 check my account 2 months later 2 confirm taht nothing was in it……..they wanted to charge me £30……bloody ridiculious.

I hope not i’m trying to claim £2700 off them, I’ll be gutted if they win:cry:

as far as I’m aware, the banks have never gone to court over this, and everybody in some capacity has been rewarded. they’re now taking a hard line tactics but still avoiding court at all costs.

i thought i read on the news a little while ago that the banks won 1 case, i will have to look though as i cant quite rememeber……

:yakk: ive sent lloydstsb a letter claiming the 1200 they owe me over 12 months of ridiculous charges and they say that theyre not going to repay anything untill a big court battle deciding whether these charges are justified is over,

basically hoping that they dont have to pay,

but if it goes in our favour then by law they will HAVE to pay back 100% of unjustified charges,

so i gotta wait, and wil probvs never see a penny of that stolen cash again

    Yeah,

Lucky for me I don’t have any loans or credit cards etc and I have never gone over my overdraft limit. I suppose i’m just being a tite arse! Can’t really understand it still though as I don’t no why it is free to draw my money out in England but two quid a go in another. Perhaps I should do some research :crazy_dru
