  • Anyone here ever tried to visit the USA with a drug conviction?

My mate has a minor conviction for the possession of cannabis, the conviction is spent and well over 10 years old but I’m worried that immigration will turn her back if she shows up there.

    Any info appreciated, cheers

I thought if you’d ever had a drugs conviction you werent allowed in, but im not sure.. id contact the US Embassy mate…

    I think you’re right mate

was it a conviction or a caution?

have a look here mate looks like it might hold some info didnt have much time to read it.

AFAIK they will need a special kind of visa which needs to be applied for in advance.

Yup AFAIK like Raj said they need a special visa. I think you need to have an interview at the Embassy in London before you get it.

I think they make you do all this to save you from getting all the way to the states and being sent back.

One thing a friend did as they didn’t have time to get the Visa or interview etc was they went Via Shannon Airport in Ireland. It has its own US immigration there so if you do get stopped and told you’re not allowed in at least its only Ireland to get back from.

Here’s the Info on the US embassy site for getting a visa with a convicition. http://www.usembassy.org.uk/cons_new/visa/niv/add_crime.html

here’s a wee quote from that section on applying for a visa with a conviction

    Quote:
Additional Administrative Processing : Criminal Convictions

Under United States visa law, people who have been arrested at anytime are required to declare the arrest when applying for a visa. If the arrest resulted in a conviction, the individual may be permanently ineligible to receive a visa. In order to travel, a waiver of the permanent ineligibility is required. The Rehabilitation of Offenders Act does not apply to United States visa law. Therefore, even travelers with a spent conviction are required to declare the arrest and/or conviction.

    Applying for the visa

You are required to schedule an appointment for an interview with a U.S. Consular Officer.
Applicants applying for visas in London are required to request an appointment with the Visa Coordination Officer to allow sufficient time for their case to be reviewed, as their application will be subject to greater scrutiny.

Applicants with criminal histories who do not request an apointment with the Visa Coordination Officer may be required to return to the Embassy at a later date if there is insufficient time to evaluate their case.

Thanks for the advice and info guys, really appreciate it.

    😉

It would seem that minor drug offences are ok for visits but migration is iffy.

John Lennon didn’t want to leave the US because he was worried he wouldn’t get back in.

I am somewhat puzzled how a nation built on genocide and land theft can have the gall to “exclude undesirables”.

I am even more puzzled why people would want to visit… guess family obligations covers that.

Canada can be a bitch to get into for the same reason, I know that much.
